Understanding Wage and Hour Laws

Wage and hour litigation focuses on enforcing the rules that govern how workers must be paid. These rules are set out in both federal and state law.

The Fair Labor Standards Act (FLSA) is a federal law that requires employers to pay minimum wage for all hours worked, and overtime for hours worked in excess of 40 per week.  It also prohibits off-the-clock work, and forbids employers from misclassifying employees as exempt or as independent contractors. 

The Pennsylvania Minimum Wage Act (PMWA) provides additional wage protections for Pennsylvania workers.  In some cases, the PMWA provides more generous protections than the FLSA, because it requires compensation for a broader range of activities than the FLSA. 

Employers who violate these laws can be held responsible for unpaid wages, double damages (known as “liquidated damages”), and attorneys’ fees.  In many cases, wage violations affect groups of workers, making them eligible to file class or collective action lawsuits.
